Williams v. Service Master
Case Background:
Ben Baer represented a landscape worker, David Williams, 32, who received $26.55 million from the companies responsible for maintaining his work truck.
Ben and other attorneys representing Mr. Williams argued that Service Master learned in October of 2011 that the tires on David’s truck were bald and dangerous – yet chose not to spend the few hundred dollars necessary to replace the tires. A month later, David drove the truck in standing water. The bald tires hydroplaned and the truck crashed. David, the father of three young sons, was left a quadriplegic.
Case Result:
After picking a jury and as openings were set to begin, this case settled for $26.55 million. At the time, this settlement was largest pre-verdict settlement in a Philadelphia County personal injury case.
“David hopes that in some way, this settlement sends a message to all those who own, operate and/or service fleet vehicles. Remember David when you do an inspection, never look the other way when you see a defective tire, worn brakes or some other hazardous condition that can ultimately cost someone their life,” said Ben Baer, while representing Williams.
