Case Background:

Ben Baer represented a minor who suffered horrific burn injuries to over 65% of his body in a food truck explosion. On July 1, 2014, the La Parrillada Chapina food truck exploded in the Feltonville section of Philadelphia. The fires killed a mother and daughter and injured 11 others, including Ben’s client. Numerous law firms worked collaboratively together to determine that the propane cylinder fueling the food truck lacked an essential safety valve and was improperly filled with propane, a violation of federal regulations. As the temperatures rose under the July sun, the propane in the tank expanded. The pressure grew until the tank burst and the propane vapors escaped.  A moment later, the propane ignited, causing the explosion.

Case Result:

On behalf of their clients, the plaintiffs’ team reached a global resolution of $160 million. Ben’s client received the largest recovery of all plaintiffs, totaling over $69 million. At the time, this was the largest individual pre-verdict settlement in the history of Pennsylvania State Court.
